Terms & Conditions

Agreement

This agreement was made between T3Leads.com (SITE we/us/our), and the Member Webmaster submitting this application (Webmaster or you/your), on the date the online application form is submitted to and approved by the SITE.

Definitions

For purposes of clarity, the terms "we", "our", "us", "T3leads" refer to and/or mean any of the trademarks, service marks, trade names, names, designs, logos, images and/or other proprietary names or marks of D and D Marketing; "you", "Affiliate", and "Affiliates" refer to the other party to the contract formed by your acceptance of these Terms and Conditions; "Affiliate Program" refer to your participation in the promotion of our products and services.

"Lead" means a potential customer of financial product, defined by a filled application. After coming to our destination website through merchant banner or etc, a visitor is asked to sign up for an application; upon submitting information, she/he becomes a lead.

"Total revenue" means the amount earned by approved Webmaster for each valid lead. T3Leads.com will provide statistics in online mode. Statistics are located at Control Panel.

"Content" means text, images, information and other materials provided or uploaded to Your store using our data feed.

"Link" means a URL hyper linked to text, a graphic, a search field or another information object on Your Site.

"Your Site" means the website where you will place our codes.


Warranties

Webmaster further warrants that Webmaster is at least eighteen (18) years of age or over the age of majority if Webmaster resides and/or conducts business in states, provinces or countries where the age of majority is greater than eighteen (18) years, and can submit proof of age upon request by SITE. Webmasters may not participate in the program in any way if they are not of the age of majority in the state, province or country where Webmaster resides and/or conducts business.

Approval

T3Leads.com may not approve webmaster and cancel account. T3Leads.com may demand additional information about the source of traffic before approval.

Commision

T3Leads.com will pay you:

• stable commission for every valid lead
• referrals earnings.

Payment

T3Leads.com has two pay periods:

• from the 1st day of the month to the 15th day of the month,
• from the 16th day of the month to the end-of-month.

T3Leads.com will pay earned revenue within fifteen (15) days of the end of the pay period.

Payment methods: Fethard, WebMoney, Epassporte, Wire Transfer.
Minimum payments: $100.
No payout fees.

If your account has earned less than minimum payment in any given month, that balance will be carried over from month to month until it has reached the minimum payment. T3Leads.com has right to withhold payment for a reasonable time to ensure that the total revenue is correct.

Restrictions

T3Leads.com accepts only traffic from the U.S.

T3Leads.com will not accept the traffic coming from public or open proxy servers, clicks from IP addresses that have bot activity.

T3Leads.com will not accept any traffic which comes from (T3Leads.com will terminate your account immediately if your website is found to have any of the following):

• any form of SPAM activity,
• hacking, phreaking activity,
• spyware or adware ads,
• any other illegal activity,
• websites that contain warez,
• websites that contain cracks,
• websites that contain child pornography,
• websites that contain rape or bestiality,
• websites that contain any illegal content,
• any activity that we feel is unsuitable for our advertisers.

T3Leads.com may demand detailed information about source of traffic.
We will not accept any traffic which comes pay per view, pay per surf programs.

Promotion materials

Webmaster may use promotional materials and scripts that are located on webmaster area only to promote T3Leads.com products and services.

Relationship of Parties

You and we are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on T3leads behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict anything in this paragraph. Neither party will have the right or authority to create any obligation or responsibility on the other's behalf.

Indemnification

You agree to indemnify and hold T3leads, its parent company, its respective directors, officers, employees, agents and representatives harmless from any and all claims, suits, actions or other proceedings brought against T3leads based on or arising from any claim that our use of any material provided by you infringes on any copyright, patent, trademark, trade secret or any other intellectual property right of any third party, or resulting from your breach of this Agreement. You will pay any and all costs, damages, and expenses, including but not limited to reasonable attorney's fees and cost awarded against or otherwise incurred by T3leads in connection with or arising from any such claim, suit, action or proceeding.

Warranty Disclaimer

T3leads makes no guarantee, warranty or representation, expressed or implied, regarding the condition, merchantability or fitness of the information or communication services provided through T3leads for any particular use or purpose. All information, interpretations and translations are provided on "AS IS" basis.

Limitation of Liability

We will not be liable to you for any indirect, incidental, special or consequential damages of any kind (including, without limitation, loss of revenue or goodwill or anticipated profits or lost of business) under or with respect to this Agreement, even if T3leads knows or should know of the possibility of such damages. Furthermore, in no event shall T3leads' cumulative liability arising under or with respect to this Agreement or the Program shall exceed the total referral fees paid to you under this Agreement.

Modifications

T3Leads.com reserves the right to change any of these terms and conditions at any time with advance notice.

Termination

T3Leads.com does not terminate Webmaster from the T3Leads.com program without advance notification for the reason.

Jurisdiction

This Agreement and all matters arising out of or otherwise relating to this agreement shall be governed by the laws of the U.S.
